These Terms of Service ("Terms") govern access to and use of the SMMKit service, including the website smmkit.app, the hosted validation API, and the Panelora — SMM Reseller for WooCommerce plugin. They are subject to Spanish Royal Legislative Decree 1/2007 (consumer protection), Spanish Law 7/1998 (general contract conditions), and applicable EU law on digital services.

2. Subject
SMMKit comprises two distinct components:
- Panelora plugin: open-source software under the GPL-2.0-or-later licence that the user installs on their WordPress site and which enables resale of social media marketing ("SMM") services through WooCommerce. Fully functional without an account.
- SMMKit service (optional): hosted API at smmkit.app that resolves public metadata from Instagram, TikTok, YouTube, Facebook, X, and Threads for the plugin's preview and multi-post selector features. Requires an account and a subscription.
3. Acceptance
Use of the website and creation of an account imply express, unreserved acceptance of these Terms as in force at the time. If you disagree with any part, you must refrain from using the service.
4. Capacity and registration
Users represent that they are of legal age and have the capacity to contract. Registration requires accurate, up-to-date information. The user is responsible for the confidentiality of their credentials and for all activity performed under their account.
5. Subscription and prices
Current prices and plans are published at smmkit.app/pricing. Fees are billed in advance on a monthly or annual basis depending on the plan. Prices include applicable taxes when so indicated; otherwise taxes are added at checkout.
Users may upgrade, downgrade or cancel at any time from their dashboard. Cancellation takes effect at the end of the current billing period, without pro-rated refunds unless required by applicable law.
6. Right of withdrawal (consumers)
When the user is a consumer within the meaning of Art. 3 of Spanish RDL 1/2007, they have 14 calendar days from contracting to withdraw from the service without justification, unless they have expressly requested immediate provision and consumed it in full before the deadline (Art. 103.m RDL 1/2007).
To exercise the right of withdrawal, send an unequivocal communication to [email protected] with your name and contracting date. We will refund within 14 calendar days from receipt of the withdrawal, using the same payment method.
7. Acceptable use
The user agrees not to:
- Use the service for unlawful purposes or contrary to public morals.
- Infringe third-party rights, including IP rights.
- Reverse-engineer the API, circumvent technical limits, abuse the system through unauthorised automation, or attempt unauthorised access.
- Upload malicious, harmful or infringing content via the plugin or the service.
- Resell the SMMKit service itself to third parties without prior written consent; reselling the resulting SMM services to end customers is permitted (it is the intended use of the Panelora plugin).
We reserve the right to suspend or terminate accounts that breach these Terms, with prior notice when feasible.
8. Availability
We aim for reasonable availability but do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be announced when practicable.
9. Limitation of liability
To the extent permitted by applicable law, SMMKit's aggregate liability for any claim arising from these Terms or the use of the service shall be limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim. Indirect damages, loss of profits and loss of data are excluded, save for wilful misconduct or gross negligence.
This limitation does not apply where consumer-protection law prevents liability limitation.
10. Third-party services
The service integrates third-party providers (payment gateway, hosting, upstream scraping). Use of the service implies acceptance of their applicable terms. SMMKit is not liable for temporary unavailability of third-party services.
11. Intellectual property
The website, API, "SMMKit" and "Panelora" trademarks, and all documentation are the property of the operator or its licensors. The user is granted a limited, non-exclusive, non-transferable licence to use the service in accordance with these Terms. The Panelora plugin is distributed under GPL-2.0-or-later when obtained through WordPress.org, which prevails over these Terms only with respect to the plugin code.
12. Changes
We may modify these Terms to reflect legal or service changes. Material changes will be emailed to registered users at least 15 calendar days in advance. Continued use after the effective date implies acceptance.
13. Termination
Either party may terminate at any time. Termination by the operator for user breach may be immediate and without refund. Clauses on IP, liability, and governing law survive termination.
14. Governing law and jurisdiction
These Terms are governed by Spanish law. For any dispute, the parties submit to the courts of the consumer's domicile when acting as such. In B2B relationships, the parties expressly submit to the courts of Barcelona, Spain.
